TERMS OF SERVICE

[6.1] Notice of Agreement

By booking a Professional Tutoring session with the Nobel Tutoring Service (“Nobel”), you accept and agree to the Terms of Service (“Terms”) in their entirety. You shall observe the Terms, along with rules and regulations not explicitly stated herein. You should not book Professional Tutoring sessions with Nobel if you do not agree with these Terms.

[6.2] Service Area

Nobel serves NYC (all 5 boroughs), New Rochelle, Pelham, Mount Vernon, Yonkers, and Long Island (Nassau and Suffolk counties).

[6.2.1] Blackout Dates

“Blackout Dates” are dates when Nobel is unavailable. Blackout dates shall be listed on the official Web site and social media pages listed in section [4.0] of the 2018-2019 Tutoring Brochure – check them regularly for updates!

[6.3] Minors

All persons 16 years old or younger must receive permission from, or be accompanied by, at least one parent or guardian to book a session with Nobel. Except where otherwise indicated, the Terms shall apply to both adults and minors.

[6.4] Privacy Policy

Nobel may collect basic personal information about you, such as your name, phone number, email address, and grade level. Nobel uses this information solely to:

  • Respond to appointment requests, inquiries, or feedback,
  • Schedule and confirm a Professional Tutoring appointment, or
  • Process a bill for Professional Tutoring.

Nobel keeps this information confidential and will not disclose it unless you authorize such disclosure or it is required for legal reasons.

Note: The only information Nobel collects from minors is name and grade level.

[6.5] Disclaimer

Nobel’s goal in every session is to help you gain a greater understanding of mathematics, statistics, and job search fundamentals that translate to improved academic and professional outcomes. However, please note the following:

  • nerdy.nel will not do your homework, exams, projects, or other assignments – in full or in part – for you during tutoring sessions!
  • Nobel cannot guarantee that a session – or series of sessions – will improve academic performance or understanding of the topics tutored,
  • Nor can Nobel guarantee that revised résumés or cover letters will increase your odds of landing interviews or job offers, and
  • Success in past sessions does not guarantee success in future sessions.

[6.6] Professional Tutoring Rules and Regulations

  • To request an appointment, you may contact Nobel using any of the methods listed in section [4.0] of the 2018-2019 Tutoring Brochure (except Instagram); you must make your request at least 24 hours ahead of the desired tutoring date.
    • Nobel responds to requests on a first-come, first-served basis.
    • Appointments are not official until Nobel confirms the date, time, and venue with you; the venue is usually a public area (such as a library or coffee shop), but it may also be your home in limited circumstances.
    • Nobel will not grant appointments to minors unless authorized by at least one parent or guardian.
    • Nobel reserves the right to refuse any appointment request.
  • Nobel reserves the right to end any Professional Tutoring session early.
  • You may request an extended session if time allows; Nobel grants extensions on a case-by-case basis.
  • If you behave disruptively during a Professional Tutoring session, your session will be canceled; you are responsible for all charges accrued during the session.
    • Nobel reserves the right to permanently revoke tutoring privileges to excessively disruptive tutees.
  • During mock exams, if you cheat or otherwise disobey the exam rules, both the exam and your results will be canceled; you will not receive a refund.
  • Single rates apply to one-on-one sessions.
  • Group rates apply when two or more tutees enroll in the same session for the same subject matter.
    • The group members do not have to know each other.
    • All group members must unanimously agree to receive tutoring as a group before receiving tutoring in a group setting.
    • Each group member is responsible for his or her own charges, unless all group members unanimously designate specific payees.
    • Note: If only one tutee attends a scheduled Group session, then the Single rate, not the Group rate, applies.
  • Family rates apply when two or more related tutees enroll in the same session for the same subject matter.
    • Family rates apply to married couples, step relatives, foster relatives, and adoptees; however, they do not apply to godparents or godchildren.
    • Each family member is responsible for his or her own charges, unless all family members unanimously designate specific payees.
    • Note: If a group consists of relatives and nonrelatives, then the Group rate, not the Family rate, applies. Nobel reserves the right to request proof of relationship before applying the Family rate.
  • For Group and Family tutoring, the maximum group size is 10.
  • Parents or guardians are responsible for charges incurred by minors.
  • To qualify for the Loyalty rate, you must complete at least 15 Professional Tutoring sessions within 6 months.
    • To count, the session must be at least 40 minutes long and paid in full.
    • After qualifying, you will receive the Loyalty rate indefinitely as long as you complete at least one Professional Tutoring session every 6 months. If you don’t, you must requalify.
    • Note: If you fail to pay for a session, or no-show a session, you must requalify. Repeated infractions result in permanent disqualification.

[6.6.1] Billing

Your bill for Professional Tutoring consists of the Tutoring Charge and Billing Surcharge listed in section [5.0] of the 2018-2019 Tutoring Brochure.

Note: With the exception of Nobel’s promotions or offers, Nobel will not provide Professional Tutoring for less than the rates listed in section [5.0] of the 2018-2019 Tutoring Brochure.

[6.6.1.1] Tutoring Charge

Nobel calculates this charge by dividing the hourly rate by 5, then multiplying the result by the length of the session (measured in 12-minute increments).

Note: The number of increments equals the session time (in minutes) divided by 12, rounded up.

[6.6.1.2] Billing Surcharge

The billing surcharge is:

  • $0 for cash payments, and
  • 3.9% of the Tutoring Charge for noncash payments.

[6.6.1.3] Payment Policy

  • Payment for a Professional Tutoring session is due at the end of the session; however, payment for a mock exam is due at the beginning of the session.
  • You may pay your bill with cash, a debit, credit, or prepaid card (VISA, MasterCard, DISCOVER, American Express, JCB, and UnionPay only), Apple Pay, Google Pay, and other tap-and-go payment methods compatible with Square Register, the Cash App, or PayPal; Nobel uses Square Register, the Cash App, and PayPal to process noncash payments securely.
    • Nobel accepts split payments; you may split your payment between multiple valid forms of payment in the same transaction.
  • Nobel reserves the right to assess penalties for nonpayment in accordance with section [5.4.2] of the 2018-2019 Tutoring Brochure.

Note: nerdy.nel does not carry change. If you pay with cash and overpay due to lack of exact change, you will receive a credit equal to the difference in your next Professional Tutoring session. Overpayment credits expire after 3 weeks.

[6.6.1.4] Refund Policy

All charges and surcharges are nonrefundable.

[6.6.2] Cancellation Policy

You may cancel an appointment by contacting Nobel at any time before your scheduled appointment. There is no cancellation fee.

Note: If Nobel cancels or reschedules an appointment (e.g. due to an emergency), you’ll receive a notification – you will not be charged for the session.

[6.6.3] Lateness Policy

You must contact Nobel if you expect to be late to a scheduled Professional Tutoring session; if you do not, you will be responsible for charges incurred from the scheduled start time and will not receive “make-up time” for the session time lost.

Note: If nerdy.nel is late for a session, you are entitled to “make-up time” for the session time lost, if time allows.

[6.6.4] No-Show Policy

You are considered a no-show if you fail to attend a Professional Tutoring session without canceling the session; a 20-minute grace period applies before Nobel cancels the session and declares you a no-show. Nobel reserves the right to assess penalties to no-shows in accordance with section [5.4.3] of the 2018-2019 Tutoring Brochure.

[6.7] Updates to the Terms

Nobel reserves the right to update the Terms at any time, with or without advance notification. If Nobel updates these Terms, a summary of the updates will appear on the official Web site and social media pages, and a new version number and effective date will appear at the top and the bottom of this section.
